Advising Lüchow-Dannenberg district

The business law firm Heuking Kühn Lüer Wojtek, with Dr. Stephan Witteler, Partner, Markus Lennartz, Salaried Partner, Christine Grau and Christian Miercke, Lawyers, all at the firm’s Frankfurt office, advises the Lüchow-Dannenberg district on establishing passive broadband infrastructure in public ownership and on the legally compliant design of the invitation to bid on network transfer and operating contracts under state aid law and public procurement law. The team led by Dr. Witteler also advises the district on all matters pertaining to municipal business law in connection with designing the district’s specific broadband expansion project.
 
The broadband project aims at establishing comprehensive district-wide NGA broadband coverage to close the "blank (coverage) spots." The public sector intends to establish a special purpose entity or infrastructure company to coordinate planning and expansion of passive optical fiber infrastructure. Following a Europe-wide bidding procedure, the completed broadband infrastructure is then to be managed by a private operator on a lease basis.
 
Lüchow-Dannenberg is Lower Saxony’s easternmost district with a population of some 49,000 and the most sparsely populated district in the old western German states. The district covers an area of 1,220 square kilometers. It is a member of the Hamburg metropolitan region and of Lüneburg Regional Association. The district consists of 27 municipalities, with administrative headquarters in Lüchow.
