Faster, more favorable conditions, more secure: in Monschau, public procurement can also be done differently: Heuking Kühn Lüer Wojtek provides counsel on innovative award procedure for the new public indoor swimming pool
Award procedures can also be done differently - uncomplicated, quickly and in the end more favorably than expected. Proof: the city of Monschau. According to it's advertising, Monschau offers "such a wealth of attractions that for certain one vacation is insufficient." In addition, Monschau now is offering a legal attraction. The city awarded the contract for the energetic and barrier-free restoration of its public indoor swimming pool to DERICHS u KONERTZ GmbH u Co KG.
Thereby, a single company will assume planning, construction and maintenance. The services are not carried out - as otherwise usual - by different companies, with all the problems that generally entails. The citizens are pleased with the nearly complete new construction of their indoor swimming pool in two ways. Mayor Margareta Ritter: "The costs of the swimming pool are fixed and will not be exceeded. The operating costs will be lower in the future, the quality of the construction is high - all that with attractive architecture."
This is made possible by a new award procedure, introduced by "the enchanting Eifel treasure trove" of Monschau. Legal design of and counsel to the award procedure including upstream competitive participation was provided by lawyers Dr. Ute Jasper and Jens Biemann from the Düsseldorf office of law firm Heuking Kühn Lüer Wojtek. With such a "package award," construction will be less expensive and will proceed more rapidly. A single award procedure for planning and construction is sufficient; there are no "interface risks." Also, the quality of construction is higher, which the construction company ensures in its own interest: it will take over the maintenance services for the years to come.
