Baden-Württemberg awards billion-euro contract for Stuttgart networks with Heuking Kühn Lüer Wojtek
Baden-Württemberg’s Ministry of Transport called it "the biggest success in the legislative period." Stuttgarter Zeitung even headlined "Hermann’s coup" in referring to the excellent results of Stuttgart’s Transport Minister when awarding the Stuttgart networks, which will save hundreds of millions of euros in the future with competition in regional rail transport. In addition, new trains will even be used.
Starting from 2019, Abellio and Go-Ahead are to provide transport services on the main regional routes to and from Stuttgart for 13 years. Heuking Kühn Lüer Wojtek supported the Ministry of Transport of Baden-Württemberg in designing and implementing the project.
Ute Jasper, head of the legal team, commented on the result: "The new competition concept and clear contract specifications will assist in significantly improving regional transport at half the price. As lawyers, we consider this to be a great success as well and one of which we are proud." Christopher Marx and Laurence Westen, responsible for contracts and award procedures, added: "The new vehicle financing models create broad competition and allow for very low interest rates. This shows that in the legal field it also pays off to implement creative ideas and project structures."
Unless a bidder challenges the decision, the contracts are to be awarded by November 28, 2015.
In addition to Dr. Jasper and Dr. Marx, the team working on the project included among others Dr. Laurence Westen in public procurement law, Dr. Stefan Jöster in insurance law, and Dr. Thorsten Kuthe and Felicitas Boehm in banking law.
