Banknotes: Oberthur successful on Bundesbank bid with Heuking Kühn Lüer Wojtek
Oberthur Fiduciaire will also for 2013 print a part of the Euro banknotes for the German Bundesbank. With the assistance of Heuking Kühn Lüer Wojtek, the renowned French company was able to again secure an order in the highly competitive market.
Heuking Kühn Lüer Wojtek advised Oberthur Fiduciaire during the entire bidding procedure and assisted the company in obtaining the award. In contrast to two years ago, none of the losing bidders challenged the award decision of the German Bundesbank. At the time, the decision to have Euro banknotes printed abroad caused much uproar. The Federal Public Procurement Tribunal and the Public Procurement Division of the Higher Regional Court of Düsseldorf decided that the contract award procedure was unobjectionable. In the proceeding at the time, Heuking Kühn Lüer Wojtek had successfully defended Oberthur Fiduciaire against the challenges.
A positive effect: Since the German Bundesbank decided to award the printing of banknotes in competitive bidding, prices decreased considerably. "This is an example for the fact that Public Procurement Law not only includes procedural requirements, but is an important instrument of assuring efficient procurement by the State," said Dr. Ute Jasper, Partner at the Düsseldorf office, who regularly advises Oberthur Fiduciaire on bids, jointly with Dr. Daniel Soudry, LL.M.
