Public procurement law is sufficiently flexible to award public contracts as quickly as possible, even now. In emergency situations like the current one, procurements are permitted within just a few days and, where necessary, even within hours.
- Contracts may be awarded within hours
- the deadlines of individual procedures may be reduced (all the way down to 0 hours);
- there is no minimum number of bidders that need to be addressed;
- under certain conditions, contracts may also be awarded directly;
- authorities may act as quickly as technically / physically possible.
Public procurement law is not to be applied below the threshold, as indicated in the new circular available here (in German).
