Heuking client Hertha BSC forms employee committee
Led by Marcus Becker, authorized signatory and Director Legal & Human Resources, Hertha BSC GmbH & Co. KGaA has drawn up a committee statute that governs the establishment, elections, and competencies of an “employee committee.” Early in 2024, Hertha BSC employees will already elect their representatives to this committee in secret ballots.
According to Hertha BSC GmbH & Co. KGaA’s General Manager Thomas E. Herrich, “the establishment of the employee committee is a key indication that at Hertha BSC, we are able to initiate contemporary formats and tools for employee co-determination from within the team.
”Heuking supported the relevant processes at Hertha BSC in terms of employment law. During this time, trade union ver.di also abandoned resolution proceedings that it had initiated at Berlin Labor Court for the establishment of a works council.
Dr. Johan-Michel Menke, LL.M., Partner at Heuking: “Hertha BSC is once again setting standards in professional sports. The employee committee is a more flexible, less bureaucratic, and more cost-effective approach than the statutory model of the works council. More significantly, it is a perfect approach to portray the unique characteristics of the respective business – in this case, professional soccer.”
