Heuking Kühn Lüer Wojtek obtains preliminary injunction for Pferdewetten.de against ZDF because of "Frontal 21" reporting

Heuking Kühn Lüer Wojtek obtained a preliminary injunction on behalf of Pferdewetten.de AG against German TV station ZDF and one of its subsidiaries because of its reporting on the horse betting market in Germany in the "Frontal 21" TV show

Pferdewetten.de AG is one of the largest German horse betting organizers and is an operator of the Internet platform of the same name via a Maltese subsidiary. In the report, "Frontal 21" had created the impression that those companies would evade the statutory provisions of German gambling law with reference to existing Maltese licenses. In addition, "Frontal 21" created the suspicion that Pferdewetten.de AG and its Maltese subsidiary netX Betting Limited would not have the intention of paying appropriate bookmaker taxes in Germany.

These serious allegations were unfounded and were now corrected with the preliminary injunction issued by Hamburg Regional Court. The court issued the preliminary injunction after summary review. While it is not final yet, it is binding on the TV station, however. ZDF may appeal the decision.
