New Public Procurement Directives published
The new European public procurement directives are available in the European Official Journal (EU Official Journal L 94 of March 28, 2014).
The public procurement directives govern how the public authorities procure construction, delivery and other services. The three directives pertain to about 15% of the gross national product. They apply to the Federal government, German states and municipalities as well as to private contracting authorities from the transport, energy, and water sectors. The directives will enter into force on April 17, 2014.
"The new directives must be transposed into German law within two years," said Dr. Ute Jasper, public procurement law expert at Heuking Kühn Lüer Wojtek. "While public procurement will adhere to the principles of transparency and equal treatment, there will be a lot of changes in daily practice."
Until now, the Federal Republic of Germany has never complied with the deadlines for transposing European public procurement law. Should the transposition be delayed beyond April 17, 2016, the directives will be immediately applicable as of then.
